Donation in name of deceased

#1

Post by tylerlybb »

A sister in our ward would like to make a donation in the name of her deceased husband. She received a couple income checks of his right after he passed away and she would like to pay his tithing for him just as he would have done. I have not recorded her husband's death yet. Can she do that? Once I record his death, the date of the donation will be after the date of his death. Will this be a problem?

From my personal experience, his resources now belong to his estate, which would be the appropriate entity to make the contribution. The estate can contribute to LDS Philanthropies and the donation can still be directed into the tithing funds of the Church.

An easier way, if she will be inheriting his income, would be for her to make the contribution in her name after his income becomes hers through the proper legal process.

A potential problem if she signs in to his LDS Account and makes the donation is that his bank will not honor the transaction because the account will also be a part of his estate, and the bank should be in the process of transfering those funds wherever they should be going according to his will or as otherwise intended by the laws where she lives.

A trusted legal or financial advisor would be a good point of contact for her to make sure things are done properly.
